Modelli storici e prospettive del giudizio di cassazione

Il contributo tenta di ripercorrere il ruolo e le funzioni storicamente riconosciuti al giudizio di cassazione. Dalla ricostruzione sembra emergere una attuale tendenza (teorico-pratica) volta a superare il modello di pura legittimità per accogliere il prototipo di un giudice sempre più garante dello ius litigatoris. // This contribution tries to retrace the role and the functions that are historically recognized to the Court of Cassation’s verdict. The reconstruction brings out a current tendency (both theoretical and practical) which consists in overcoming the model of mere ‘judicial review’ in order to embrace the prototype of a judge who can really guarantee the “ius litigatoris”.
