A margine di un'ordinanza in tema di responsabilità del direttore generale di società di capitali

Following an articulated judicial ruling, the academic debate on the responsibility of the general manager resumes, in order to verify, first of all, the possibility of arriving at a representation of the relative pro- file valid beyond the only apparent legal boundaries of the joint stock company. Having therefore stated that the general manager belongs to the category of executives – employed by the administrative body – the relations between the director and the companies are examined, within the legislative framework, which has changed due to the provi- sions that have modified the organizational discipline of the company. At the end of an analysis, which also aims to involve the employment relationship that binds the general manager to the company, the con- clusion is reached that this is an increasingly topical figure in every business area.
