Le collaborazioni coordinate nel “Decreto Trasparenza”. Parte prima: il campo di applicazione

The survey, which represents the first part of a more comprehensive essay, analyzes the scope of the Legislative Decree no. 104/2022, which implemented extensively the Directive 2019/1152, with reference to the so called “collaborazioni coordinate e continuative” pursuant to art. 409 no. 3 of the Civil Procedure Code (art. 1, par. 1, lett. d)). It examines also the issues arising from the exclusion of some hypothesis on the basis of the chosen legal type or the sector. The conclusive remarks are dedicated to the EU notion of worker and the choice to apply the Decree also to the so called “collaborazioni organizzate dal committente” pursuant to art. 2 paragraph 1 D.Lgs. no. 81/2015.
