abstract:
The essay analyses the critical issues of the health and safety regulatory framework applicable to “coordinated and continuous self-employed workers” (Article 409 n. 3 of the Code of Civil Procedure). Firstly, the author promotes an extensive interpretation of Article 2087 of the Civil Code. Then, he examines the rules of Legislative Decree 81 of 2008 applicable to “coordinated self-employed workers” in the light of the narrow notion of worker pursuant to Art. 2 paragraph 1 letter a, pointing out constitutional issues. The author also comments upon the basis of the organisational and “disciplinary” power of the employer in matters of safety. Finally, he examines the legal framework of work via platforms in the delivery sector and the recent legal discipline regarding the labour contracts of sportsmen and sportswomen.
