L'ESPOSIZIONE DA HIV COME REATO DI PERICOLO TRA PROFILI COMPARATISTICI E PROSPETTIVE DE IURE CONDENDO

Since the beginning of the new Millennium, a debate about the opportunity of criminalizing HIV transmission has
spread internationally. In particular, some Countries chose not to limit the application of the criminal law to the
hypotheses of HIV transmission, considering preferable to focus on the negative value of the conduct on HIV
exposure, in terms of danger and risk-taking, rather than on the harm caused by the infection. Through a compa- rative analysis, this paper aims to evaluate the impact of the introduction of this crime among public health
offences.
