This paper retraces the path of the female subject of law from its brought to light, to the claim of equality and difference carried forward from Feminist Legal Theories. The analysis highlights the evolution of the female subject from the status of subject-non-subject to the recognition of women's rights within the framework
of human rights. The aim is to understand if the female legal subject can be considered a full legal subject and to propose the recognition of a right to non-mis-gender-representation.
