La difficile semantica dei diritti sociali. Profili giusfilosofici

The present contribution outlines a philosophical framework of the category of social rights, reconstructing the debate in which different doctrinal perspectives are compared on their nature and characteristics.Among the critical observations, particular emphasis is placed on the issues related to the cost of social rights and their nature as “positive rights”, which always need state intervention to be implemented and for this reason not considered just paper rights.However, even though a first reflection on the emergency situation resulting from Covid-2019, it is appropriate to support a more realistic position, which sees in all fundamental rights the need for public intervention, even if only partial, and the need to cope with a certain ‘cost’ to allow their realization.
