Obbligazione di sicurezza e nuove tecnologie: una lettura giuslavoristica del Decreto Smart Roads

The essay analyzes the implications deriving from the experimentation of self-driving vehicles on the protection of workers' health and safety. The investigation focuses, for the first part, on the analysis of the provisions of the decree of the Ministry of Infrastructure and Transport of 28 February 2018 with the aim of verifying how this discipline intersects with the employer's prevention obligations. A second part of the investigation verifies the adequacy of the insurance protection system against accidents in the event that the worker is the victim of an accident. The conclusions of the essay show that the current prevention and accident prevention system is adequate to protect the worker in the testing phases of self-driving vehicles but, at the same time, could show some critical profiles when the driverless car is open to the use of mass (and therefore also for use for work reasons).
