La contrattazione di prossimità nella riflessione della dottrina giuslavoristica: una rassegna di questioni

This paper looks at the scholarly work produced on Art. 8 of Decree-Law No. 138/2011. The relevant research is examined which was published in leading journals and commentaries between 2011 and 2021. This analysis highlights how labour law scholars have focused on the constitutional dimension of this provision, neglecting the implications emerging from the application of the norm. This paper does not focus on the issues included in the provision, but only on the most controversial ones, even when considering the cases when this provision was implemented for the first time, thus leaving much room for improvement. The aim of this paper is to highlight the evaluations of the academic community with respect to a specific policy of law, as suggested in this paper in relation to Art. 8.
