L’inoppugnabilità delle rinunzie e delle transazioni ai sensi dell’art. 2113, comma 4 cod. civ.: gli orientamenti giurisprudenziali e i dissensi della dottrina

The contribution analyzes, through jurisprudential guidelines, main features of conciliation in trade unions. Furthermore, the conciliation procedures laid down in some contractual systems and the application implications will be illustrated, as well as the possibility of conciliation in trade unions if the collective agreement doesn’t provide anything in this regard. Finally, the study deepens the recent sentence of Rome’s Court on the subject, analyzing its critical points of interpretation. The study concludes with some considerations on the current regulatory framework.
