L'uso della comparazione come metodologia interpretativa nell'ordinanza di rimessione n. 14329/2013 della Suprema Corte di Cassazione: similarità e differenze con il caso italiano

The paper aims at providing a conceptual analysis of the use of juridical comparison in the sentence n. 14329/2013 of Italian Court of Cassation. More specifically, the paper analyses two case-laws of the German an Austrian Constitutional Courts and one of the European Court of Human Rights. This way, we want to show how these case-laws are not completely identical to the Italian one as the Italian Court of Cassation naively suggests. For example, the reasoning of case-law of the European Court of Human Rights reinforces juridically and culturally the idea that same-sex couples have no right to marriage, but just a right to respect for private and family life.
