he essay analyzes the important sentence no. 8 of 2023 by the Constitutional Court on the legitimacy of the recovery of undue social security, non-pension and salary payments, pursuant to art. 2033 of the Civil Code, when the payment comes from public entities and the recipient is in good faith. After having framed the three different cases, we will investigate the reasons under which the Consulta rejected the questions of legitimacy, confirming the conformity of the Italian legal system with European conventional law, in light of the Casarin v. ruling.
